TERMS OF SERVICE


Introduction


This Terms of Service Agreement ("Agreement") constitutes a legally binding contract between the User ("User" or "You") and Andrew's Chinese Takeaway ("Restaurant," "We," "Us," or "Our"), a duly registered entity in Ireland, governing the access to and use of the online ordering platform. By accessing, browsing, or utilizing our platform, You acknowledge and agree to abide by the terms and conditions set forth herein. If You do not consent to any part of this Agreement, You must refrain from using our Services.



General Information


Andrew's Chinese Takeaway is a food service provider, registered under business registration number 708373, with its principal place of business at Unit 2 Main Street, Shankill Dublin 18. All inquiries concerning this Agreement should be directed to contact@mymenu.ie or 01 272 0328.



Scope of Services


The Restaurant, through its online platform, offers Users the ability to browse its menu, place food orders, make reservations, and manage their accounts. The completion of any transaction via this platform establishes a binding contractual relationship between the User and the Restaurant. The Restaurant is solely responsible for the operation and functionality of the platform and all interactions with Users.


The Restaurant does not guarantee uninterrupted access to the platform and reserves the right to modify, suspend, or terminate any aspect of the Service at its discretion. The Restaurant shall not be liable for service interruptions caused by technical failures, maintenance, or factors beyond its control.



User Obligations


By utilizing the Service, You hereby agree to:


Provide truthful, accurate, and up-to-date personal information as required for the completion of transactions.

Use the platform in strict adherence to all applicable local, national, and international laws and regulations.

Refrain from engaging in any unlawful, fraudulent, or abusive conduct, including but not limited to unauthorized access, manipulation of platform functionalities, or spamming.

Maintain the confidentiality of Your account credentials and accept responsibility for all activities conducted through Your account.

Notify the Restaurant immediately in case of unauthorized account access or suspected security breaches.

Failure to comply with these obligations may result in immediate suspension or termination of access to the platform, at the sole discretion of the Restaurant.



Orders, Pricing, and Payment Terms


All orders placed via the Service constitute an offer by the User to purchase the selected items, which remains subject to acceptance by the Restaurant. The Restaurant reserves the right to reject, cancel, or modify any order at its sole discretion. Prices displayed on the platform are denominated in the local currency and include applicable taxes unless stated otherwise. Payment for all orders must be completed using one of the available methods, which may include credit/debit cards or other electronic payment solutions.


Users acknowledge that all payments are final once processed, and chargebacks or fraudulent claims may result in account suspension or legal action. The Restaurant’s refund and cancellation policies shall govern the handling of any order disputes.


Order Cancellation and Refund Policy


The User may cancel an order within a specified time window, provided that preparation of the order has not commenced. Once food preparation has begun, cancellation requests will not be honored, and no refunds will be issued unless an error is attributable to the Restaurant. Refunds, where applicable, shall be processed via the original payment method and in accordance with the Restaurant’s established refund policies.


The Restaurant reserves the right to refuse refund requests for dissatisfaction arising from subjective taste preferences, delayed deliveries due to unforeseen circumstances, or improper handling of the order post-delivery.



Loyalty Program


The Restaurant may, at its sole discretion, offer a loyalty program to incentivize repeat customers. Participation in such a program is voluntary and subject to the following terms:

Users must register an account via the Restaurant’s official website or mobile application.

Points or rewards may be accrued through qualifying purchases, promotional campaigns, referrals, or other activities specified by the Restaurant.

The Restaurant reserves the right to alter the earning structure, modify redemption options, and impose expiration dates on accrued rewards without prior notice.

Points or rewards hold no cash value and cannot be redeemed for cash or transferred to another account.

The Restaurant may terminate the loyalty program at any time. In the event of fraudulent activities or misuse of the program, the Restaurant reserves the right to revoke accrued points and prohibit further participation.

Users may be required to adhere to additional program-specific rules communicated through official channels.

Users acknowledge that participation in the loyalty program requires the processing of personal data, as governed by the Privacy Policy outlined herein. No personal data will be shared with third parties except as required by law.


Limitation of Liability


To the fullest extent permitted by law, the Restaurant shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages resulting from:


Errors, delays, or service interruptions in the platform.

Unauthorized access or use of User accounts due to negligence.

Food allergies or adverse reactions arising from consumption of the Restaurant’s offerings unless explicitly disclosed in compliance with local food safety laws.

Acts of force majeure, including but not limited to natural disasters, labor strikes, and government-imposed restrictions.

The Restaurant’s liability shall in no event exceed the amount paid by the User for the specific order in dispute.


Dispute Resolution


Should any dispute arise concerning the use of our Services, the User must first contact our customer service department at 01 272 0328 to attempt an informal resolution. If a resolution cannot be achieved, both parties agree to resolve disputes in accordance with the governing laws of the jurisdiction where the Restaurant is registered.
